The existing laws either cannot offer enough protection to the women affected by trafficking, or they are not applied with
sufficiently well by the Swiss Federal Council of Ministers. Organisations and women dedicated to these matters demand that
these legal loopholes be closed by introducing a protection programme for the women affected by trafficking. This programme
should enable the women to be granted a permit of stay in Switzerland, at least before and during criminal proceedings affecting
them. In addition to this, the definition in the Swiss Federal Penal Code should be amended to cover all forms of trafficking
in women (forced marriage, household work, prostitution, inter alia). Present practice shows that the real victims and also
witnesses of the trafficking in women are branded as criminals and expelled from the country within the shortest possible
time. In these circumstances it is practically impossible for the women to stand as witnesses against those exploiting them,
without subjecting themselves and their families to severe reprisals. However, Switzerland does have a Victim Protection Law (see OHG; SR 312.5 and Victim Assistance Regulations), whereby anyone
can seek protection who is directly impaired in their physical, sexual and mental integrity, irrespective whether the person
